0. PREAMBLE

Welcome to Velocty®, a cybersecurity software solution developed and distributed by Swyft, LLC (“Swyft,” “we,” “us,” or “our”). By accessing or using Velocty® (the “Software”), you agree to comply with and be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, please do not use the Software.

1. OVERVIEW OF VELOCTY

Velocty® is a comprehensive cybersecurity solution designed to protect your network and devices. It offers various modules that facilitate malware protection, network management, and device control. Velocty® provides users with a user-friendly interface to monitor and manage their security environment effectively.

Key Features Include:

  • Network Monitoring: Continuous monitoring of your network for potential threats and vulnerabilities.
  • Device Management: Ability to enable or disable devices connected to your network.
  • Malware Protection: Integration with Malwarebytes for robust malware detection and removal.
  • Threat Analysis: Utilizing Velocty® Stop to scan files and URLs for malware and other security threats.

2. USER RESPONSIBILITIES

By using Velocty, you agree to:

  • Ensure that all information provided during the registration process is accurate, current, and complete.
  • Use Velocty® only for lawful purposes and in accordance with these Terms.
  • Maintain the security of your login credentials and be responsible for all activities that occur under your account.
  • Promptly notify us of any unauthorized access or use of your account.

3. ACCESS AND USE OF SOFTWARE

Velocty requires access to your network and devices to provide its full range of features. By using the Software, you consent to the following:

  • Velocty® will scan your devices and network to identify potential vulnerabilities.
  • The Software may manage device settings, including the ability to turn devices on or off, as deemed necessary for security purposes.
  • Velocty® will analyze files and URLs for threats using integrated tools including, but not limited to Malwarebytes and VirusTotal.

4. USE CASE SCENARIOS

Velocty is designed for various use-case scenarios, including but not limited to:

  • Small Business Security: Protect your business network from malware, unauthorized access, and potential data breaches.
  • Remote Work Environment: Ensure that remote employees' devices are secure and compliant with your organization's security policies.
  • Incident Response: Quickly assess and respond to security incidents by managing devices and monitoring network traffic in real-time.

5. LIMIATIONS OF USE

While Velocty® provides powerful security features, it is not infallible. You understand and acknowledge that:

  • No security software can guarantee complete protection against all threats.
  • You are responsible for regularly updating your operating systems and applications to maintain security.
  • Velocty®, nor Swyft, LLC., are not responsible for any damage or loss of data resulting from the use of the Software or any failure to provide adequate protection.

6. INTELLECTUAL PROPERTY RIGHTS

All content, features, and functionality of Velocty®, including but not limited to text, graphics, logos, and software, are owned by Swyft, LLC., and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content from Velocty without our express written consent.

7. DISCLAMER OF WARRANTIES

Velocty® is provided on an "as-is" and "as-available" basis. We do not warrant that the Software will be uninterrupted, secure, or free of errors. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Swyft, LLC., shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of Velocty®. This limitation applies whether the alleged liability is based on contract, tort (including negligence), strict liability, or any other legal theory, even if Swyft has been advised of the possibility of such damage.

9. INDEMNIFICAITON

You agree to indemnify, defend, and hold harmless Swyft, LLC., its affiliates, officers, directors, executives, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of Velocty®, your violation of these Terms, or your infringement of any third-party rights.

10. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Connecticut, United States, without regard to its conflict of law principles. You agree to submit to the personal jurisdiction of the courts located in the state of Connecticut for the resolution of any disputes.

11. CHANGES TO TERMS

We may revise these Terms at any time without prior notice. Any changes will be effective immediately upon posting on our website or within the Software. Your continued use of Velocty® after any modifications signifies your acceptance of the revised Terms.
